Eligibility

You must be at least 18 years old, or have the permission of a parent or guardian, to use the Site, to enroll in our text messaging program, or to enter into a service agreement with us.

Use of the Site

You may use the Site for lawful purposes only. You agree not to interfere with or disrupt the Site, attempt to gain unauthorized access to any part of it, use automated tools to scrape or overload it, or use it in a way that infringes the rights of others.

SMS Text Messaging Terms

Program Description

ROAM Bike Shop operates a text messaging program used to communicate with customers about service and repair updates, pickup notifications, appointment reminders, and replies to customer questions. Messages are limited to customer care and transactional messages about your business with us. We do not send marketing or promotional text messages.

Consent and How to Opt In

You may opt in to receive text messages from us by texting us at (651) 478-2200, or by providing your mobile phone number and giving your consent in person at our store. Consent to receive text messages is not a condition of any purchase. By opting in, you confirm that you are the subscriber of the mobile number you provide or that you are authorized to consent on the subscriber’s behalf.

Message Frequency and Cost

Message frequency varies and depends on your interactions with us. Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Contact your carrier for details about your plan.

Opt Out

You can cancel at any time by replying STOP to any message from us. After you reply STOP, we will send one confirmation message and you will not receive further messages from us unless you opt in again. You may also ask us to remove your number by calling (651) 478-2200 or by telling us in store.

Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless service provider and is not guaranteed. Supported carriers may change without notice.

Privacy

Information collected through our messaging program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Service, Repair, and Sales

• Estimates for service and repair are approximate. If the work required changes materially from the estimate, we will contact you before proceeding.
• Bikes and parts left with us must be picked up within 30 days of notification that the work is complete unless we agree otherwise. Items left beyond that period may be subject to storage fees or disposal as permitted by Minnesota law.
• Product warranties are provided by the manufacturer and are subject to the manufacturer’s terms. We will help you submit a warranty claim, but we do not extend or alter manufacturer warranties.
• Our labor is warranted against defects in workmanship for a reasonable period following the service. Normal wear, damage from crashes or misuse, and issues arising from parts we did not supply are not covered.
• Prices, availability, and shop hours are subject to change without notice.

Assumption of Risk

Bicycling and e-bike riding involve inherent risks, including risk of serious injury. You are responsible for riding safely, wearing appropriate protective equipment, following all applicable traffic laws, and inspecting your bicycle before each ride.

Intellectual Property

The Site and its content — including text, images, logos, and design — are owned by ROAM Bike Shop LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or use our name, logo, or content without our written permission. Third-party brand names and logos are the property of their respective owners.

Third-Party Links

The Site may link to websites we do not operate. We are not responsible for the content, products, or practices of those sites, and a link does not imply endorsement.

Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that information on the Site — including hours, pricing, and availability — is complete or current. This section does not limit any warranty that applies to goods or services you purchase from us under applicable law.

Limitation of Liability

To the fullest extent permitted by law, ROAM Bike Shop LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Site or our messaging program. Our total liability for any claim relating to the Site or the messaging program will not exceed one hundred dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless ROAM Bike Shop LLC from any claims, losses, or expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms or of applicable law.

Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Any dispute arising out of these Terms, the Site, or our messaging program will be brought exclusively in the state or federal courts located in Ramsey County, Minnesota, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site or our messaging program after a change takes effect means you accept the updated Terms.
